On January 27, 2022, Greg Vanden-Eykel will be joining a panel hosted by Massachusetts Lawyers Weekly to discuss a decision by the state’s highest court, which ruled an employee’s exercise of his rights under the state’s Personnel Records Act can serve as the basis of a suit alleging wrongful discharge. The case involved an employee who was on a performance plan and who submitted a rebuttal challenging the performance improvement plan, as is permitted under M.G.L.c. 149, §52C, and was fired the same day. The panel will discuss §52C, analyze the decision’s impact on employers, and offer advice on how businesses should proceed.
