Rhode Island Supreme Court Issues Important Ruling on School Funding

Stephen Adams and Derek Gillis achieved a significant appellate victory on behalf of the Newport and Cumberland School Committees in a case clarifying education funding obligations. The Rhode Island Supreme Court ruled that school districts are not required to reimburse the Department of Children, Youth, and Families (DCYF) for general education costs when students placed in residential treatment programs are not receiving special education services.

For educators, administrators, and school committee members, the decision provides essential guidance:

  • Districts are responsible only for costs clearly written into the law
  • References to general education reimbursement were deliberately removed from the statute
  • Schools cannot be required to pay costs the Legislature did not authorize
  • Local education budgets are protected from unexpected funding obligations

Reflecting on the decision, Steve Adams said: “This decision protects school districts from being burdened with costs the Legislature never intended, ensuring local budgets can focus on serving students.”
