Angela L. Carr and Jenna R. Pingitore recently obtained a jury verdict on behalf of a physician following a 4-day trial in Federal District Court in Boston, Massachusetts. The Plaintiff alleged that the orthopedic surgeon failed to warn her of potential risks related to a metal allergy before a total knee replacement which she believed caused her implant to fail.
A Federal Court jury in the United States District Court for the District of Massachusetts took less than two hours following the 4-day trial to return a verdict in favor of the physician.
“We are pleased the jury quickly concluded that our client appropriately advised the patient of all material risks associated with a total knee replacement consistent with the medical literature in the field of orthopedics and obtained her informed consent to proceed with the surgery,” said Carr.
